TERMS AND CONDITIONS
Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at:
https://2021.samsungpromotions.claims/TVandSoundbarcashback/en-GB (in the United Kingdom) and https://2021.samsungpromotions.claims/TVandSoundbarcashback/en-IE (in the Republic of Ireland) form part of these Terms and Conditions.
The Promoter
1. The Promoter is Samsung Electronics (UK) Limited, 2000 Hillswood Drive, Chertsey, Surrey, KT16 0RS (the “Promoter”).
Promotion Period
2. The Promotion will commence at 00:01 (GMT) on 25th January 2023 and close at 23:59 (GMT) on 14th March 2023 (the “Promotion Period”).
Eligibility
3. To be eligible to participate in the Promotion you must be a resident (aged 18+) of either the United Kingdom (including Isle of Man or Channel Islands) or the Republic of Ireland ("Individual Participant") or a Company registered in one of the same territories (“Company Participant”), in either case with a bank account in GBP (UK) or in Euros (ROI). For the avoidance of doubt, within these Terms and Conditions the term ‘Participant’ shall be taken to refer to both Individual Participants and Company Participants (and the applicable plural) unless stated otherwise. Staff members of the Promoter are eligible to participate as long as they have not received a discount on a Promotion Product purchase.
4. Employees or agents of the Promoter that are involved in the operation of this Promotion or anyone professionally connected to this Promotion are not eligible to enter.
5. Retailers, distributors, resellers and any person who purchases a Promotion Product (defined below) for resale or otherwise not as the user of the Promotion Product, may not participate in this Promotion and are specifically excluded as Participants.
Offer
6. Samsung is offering a promotion (the “Promotion”) whereby a Participant will be eligible to claim a cashback reward in a variable amount as shown at Table 1 below (the “Reward”) by redemption when purchasing a qualifying selected new (i.e. not second hand, refurbished or ex-display) Samsung TV or Soundbar product (also as listed at Table 1 and hereafter known as a “Promotion Product”) from a Participating Retailer listed [HERE]. Additionally, Participants who purchase a second Promotion Product during the Promotion Period where the resulting combination is one TV and one soundbar from the same Participating Retailer (but which does not have to be in the same transaction as the first purchase) and make a valid Claim, shall also be eligible to claim an additional cashback Reward, in the amount of £50.00 / €60.00 (an “Additional Reward”). All Rewards, including Additional Rewards, and Claims are subject to the limitations set forth in Condition 12 below. Rewards will be paid by bank transfer in GBP or EUR to the bank account nominated in the Claim (as defined below). For the avoidance of doubt, within this Statement of Work the term ‘Participant’ shall be taken to refer to both Individual Participants and Company Participants (and the applicable plural) unless stated otherwise. Unless stated otherwise within these Promotion Terms, reference to the term “Reward” shall be taken to refer to both the Reward and the Additional Reward.
7. Rewards shall be paid by way of bank transfer and Participants must have a valid bank account in GBP (for the UK, IOM or CI) or EUR in order to receive the Reward. Rewards shall be awarded to Participants based on their country of residence, for example a ROI Participant shall receive their Reward in EUR rather than GBP in accordance with Table 1 below. For the avoidance of doubt Participants must have a valid bank account in their individual or company name, and included on their Claim form to receive their Reward(s).

8. Purchases from auction websites (e.g. eBay) or from third party sellers on online retailers’ websites (e.g. Amazon Marketplace) and non-Samsung approved resellers (non-direct accounts) are specifically excluded from this Promotion.
Claims
9. After purchasing both Promotion Product(s) from the same Participating Retailer during the Promotion Period, Participants must visit https://2021.samsungpromotions.claims/TVandSoundbarcashback complete the Claim form with their name, contact information, email and postal address and any other requested information including the serial numbers of the purchased Promotion Products then submit it together with a scanned copy of their proof(s) of purchase showing their purchase of the Promotion Product(s).
10. Claims may only be submitted within thirty (30) to sixty (60) days of the Participant purchasing the relevant Promotion Products (the “Claim Period”), meaning the final Claim date for Promotion Products purchased on the 14th March 2023 is no later than 23:59 (BST) on the 13th May 2023.
11. In the event of late delivery of the Participant’s Promotion Product, Participants will be able to register and save their information in the Claim form during the Claim Period, tick a box stating that they have not received their Promotion Product and return to complete and submit their Claim within zero (0) to sixty (60) days of commencing their Claim.
12. Participants are entitled to claim on a maximum of four (4) Promotion Products purchased per residential household, with a corresponding maximum of four (4) Rewards and two (2) Additional Rewards,. Company Participants are entitled to claim on a maximum of ten (10) Promotion Products purchased per business, with a corresponding maximum of ten (10) Rewards and five (5) Additional Rewards.
13. Participants will be sent an email to confirm their Claim has been received by the Promoter instantly upon entry of a Claim. Providing that the Claim is found to be valid in accordance with these Promotion Terms, Participants will be sent an email within seven (7) days to confirm whether their Claim has been successful and validated (“Claim Validation”).
14. If an email acknowledgement has not been received, it is the Participant’s responsibility to contact the Promoter’s customer service team by email at tvandsoundbarcashback@samsungpromotions.claims or by phone at 0330 054 5523 (UK) or +353 1800 851 879 (ROI) within seven (7) days of a Claim being submitted.
15. For the avoidance of doubt, to be eligible for the Additional Reward, Participants are required to purchase the second Promotion Product from the same Participating Retailer as the first Promotion Product and otherwise in full accordance with these Promotion Terms.
16. If a Claim is deemed to have been submitted incorrectly, the Participant will be notified via email and SMS and offered the opportunity to provide the required information within seven (7) days. If no response is received within seven (7) days of the email and SMS, then the Claim shall be marked as invalid and the Participant will no longer be eligible to receive the Reward.
17. Claims that are incomplete or damaged will be deemed invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of Claims.
18. The Reward will be sent via bank transfer within forty-five (45) days of Claim Validation to the bank account provided by the Participant during the Claim process.
19. The Promoter reserves the right at its absolute discretion to disqualify Claims which it considers do not comply with these Promotion Terms.
20. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age and other relevant details of a Participant. In the event your information is linked to fraudulent claims or abuse of terms and conditions on previous promotions you will be unable to participate in this Promotion and your Claim will be rejected.
21. If a Participant returns or cancels the delivery of a Promotion Product before submitting a Claim, the Participant must not make a Claim. If a Participant returns or cancels the delivery of a Promotion Product after submitting a Claim, the Claim will be invalid and the Participant must cancel the Claim immediately by calling 0330 054 5523 (UK) or +353 1800 851 879 (ROI). The Promoter reserves the right to check with Participating Retailers whether a Promotion Product has been returned or the order cancelled and by submitting a Claim the Participant provides consent to the Promoter to do so.
Privacy and Data Protection
22. The Promoter’s use of any personal information submitted by the Participant shall be limited to communications about the Promotion and for managing the redemption process. The Participant hereby consents to its personal information being used for this purpose and confirms that it agrees with the Promoter’s privacy policy available at: www.samsung.com/uk/info/privacy.html. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy.
23. Other than as set out in these Terms and Conditions, the details and information provided by the Participant when entering the Promotion or claiming the Reward will not be used for any other purpose, nor shall they be passed to any third party.
General
24. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.
25. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.
26. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.
27. Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in these Promotion Terms as being included.
28. By participating in this Promotion, you agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Reward. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.
29. The Promotion is governed by the law of England and Wales.
