  • Galaxy Free Trial Program – Terms and Conditions

    1. This Galaxy Free Trial Program (this “Promotion”) is organized by Samsung Electronics H. K. Company, Limited ("Samsung") and will be held in the below period (the “Promotion Period”). This Promotion is available to each customer who holds a Hong Kong Permanent Identity Card (“HKID”), and registers to participate in this Promotion at below stores (“Designated Store”) during the Promotion Period (“Eligible Customer”).

    2. By participating in this Promotion, each Eligible Customer agrees to be bound by these Terms and Conditions. Samsung reserves the right to amend these Terms and Conditions, please check for updates on the Promotion page, the latest version shall prevail. If there is any inconsistency between these Terms and Conditions and any advertising, publicity and other materials relating to or in connection with this Promotion, these Terms and Conditions shall prevail.
    3. Each Eligible Customer is required to complete and sign the “Galaxy Free Trial Program Registration Form” under the https://galaxyfreetrial.udshkcloud.com and pay the required deposit (“Deposit”) based on the corresponding borrowed product model listed in the below table (“Designated Product”) by credit card at Designated Samsung Experience Store in order to borrow the Designated Product.

    4. Each Eligible Customer is required to register a booking via https://galaxytrial.udshkcloud.com with a payment of HK$100 holding fee (such holding fee will be refunded after the Eligible Customer picks up the trial device according to booking registration) and subsequently go to the Designated Store according to the booking time, to complete and sign the “Galaxy Free Trial Program Registration Form”. During the registration process, staff will record the credit card information of the Eligible Customer (such details would only be kept until return of the trial device by the Eligible Customer). Upon fulfilment of the whole registration process, the Eligible Customer is successfully enrolled to the Galaxy Free Trial Program and can borrow the trial device - either Galaxy Z Fold5 256GB, Galaxy Z Flip5 256GB, or Galaxy Tab S9 Ultra 256GB (“Designated Product”).
    *Eligible Customers cannot choose the color of the Designated Product
    5. Each Eligible Customer can register to borrow each model of Designated Product for once, and can redeem the Gift (defined below in clause 11) for once upon meeting the eligibility criteria.
    6. Each Eligible Customer can enjoy 5 days of trial of the Designated Product. Eligible Customer is required to return the Designated Product on or before the 5th calendar day from the borrow date stated on the Galaxy Free Trial Program Registration Form (“Eligible Return Period”). If Eligible Customer fails to return the Designated Product within the Eligible Return Period, Recommend Retail Price of the Designated Product will be charged on the 6th day from the borrow date.

    Example of calculation of Eligible Return Period:
    If the Eligible Customer borrows the Designated Product on 20 Oct 2023, return should be made on or before 25 Oct 2023 The Designated Product will be locked automatically and cannot be used after the expiry of the Eligible Return Period.
    7. The Eligible Customer must arrive in-person at the designated shop to return the Designated Product with the following items within the Eligible Return Period; otherwise, Recommend Retail Price of the Designated Product will be charged.
    ◦ Original Designated Product that meets the minimum criteria as defined below in clause 8 (“Criteria”)
    ◦ HKID
    8. General wear and tear that would be reasonably expected from 5 days’ use is acceptable. Whether the device condition of the Designated Product is able to meet the Criteria will be determined by the professional judgement and final decision of our authorized technicians. The returned Designated Product would be able to meet the definition of the minimum Criteria if:
    ◦ It can be switched on
    ◦ It is returned with its original and functional in-box accessories
    ◦ It has no damage on body and the screen
    ◦ It has no physical damage and bent
    ◦Folding axis operate normally
    ◦ It is unlocked and logged-out of all Samsung / Google / relevant user accounts and with all passwords and personal data removed
    9. If the Designated Product cannot meet the Criteria and suffered the following damage conditions, Eligible Customers will be charged by the below repair costs based on the respective damage condition.

    10. If the Designated Product is lost or cannot be switched on, Eligible Customers will be charged by the Recommended Retail Price of the Designated Product:

    If the in-box accessories of the Designated Product are lost or seriously damaged that become un-usable, Eligible Customers will be charged by the below captioned amount:

    11. Deletion of all data and information stored in the Designated Product returned is the Eligible Customer’s absolute responsibility. Samsung accepts no responsibility for the Eligible Customer’s personal data and software or for any loss or damage to such data and software.
    12. Each Eligible Customer, who purchases Galaxy Z Fold5 or Galaxy Z Flip5 at Designated Store after completion of the Galaxy Free Trial Program, and successfully processed and completed trade in of an Eligible Old Device (defined below), will be eligible to redeem “Galaxy Free Trial Offer”, that is, additional HK$800 Trade In Offer (“Offer”). Each Eligible Customer, who purchases Galaxy Tab S9 Series at Designated Store after completion of the Galaxy Free Trial Program, will be eligible to redeem “Galaxy Free Trial Gift”, that is, Galaxy Buds Live True Wireless Earbuds ( “Gift”).
    13. The use of Samsung Trade-in is subject to its respective service requirements as well as Terms and Conditions, for details, please click “Samsung Trade-in” above to access the relevant website. Old Devices would not be eligible for processing trade-in in the following situations:
    1. After final physical assessment and inspection, the old device value is less than HK$300.
    2. Security locks and personal accounts cannot be completely removed from the old device (e.g. Pattern/Pin/Password/Biometrics/Find my mobile/Gmail account/Samsung account/iCloud/Android or Google Smart Lock etc.).
    3. Not purchased from designated authorized resellers or authorized distributors in Hong Kong
    14. Eligible Old Device includes the categories of smartphones and tablets. For the latest Eligible Old Device list, please refer to dedicated Samsung Trade-in website (Samsung Trade-in | Samsung Hong Kong) > Frequently asked questions > Eligible Trade-in Old Device List.
    15. The Gift and Offer are on a first-come-first-served basis and subject to limited quota.
    16. To redeem the Gift or Offer, each Eligible Customer shall complete the purchase at the date of return of Designated Product. The Gift or Offer will be forfeited if Eligible Customer fails to redeem the Gift or Offer within the designated period. Eligible Customer shall not make any claim against Samsung whatsoever, and Samsung shall not bear any liability whatsoever.
    17. Samsung reserves the right to disqualify any Eligible Customer from this Promotion where it has reasonable grounds to believe that Eligible Customer has violated these Terms and Conditions or any instructions and/or requirements of this Promotion, or that Eligible Customer may have gained an unfair advantage by participating in this Promotion or using fraudulent means to participate in this Promotion.
    18. The Promotion is only available to an Eligible Customer who purchased the Designated Product for private and domestic use.
    19. The Gift cannot be transferred or sold, cannot be exchanged for cash or other offers/gifts. Samsung reserves the right to change or substitute the Gift with other offers/gifts of a comparable or equivalent value as it deems fit.
    20. Non-end users (including but not limited to, distributors and resellers) are not eligible to participate in this Promotion.
    21. By participating in this Promotion, Eligible Customer agrees to exempt and exclude Samsung from all claims or liabilities of any nature arising from participating in this Promotion or otherwise related to this Promotion, including but not limited to, any damage or loss caused by the acquisition, receipt, possession, use or misuse of the Promotion, or other reasons, and any claim or ground for litigation of any type or nature which the Eligible Customer may potentially possess based on such damage or loss. The above disclaimer is not applicable to damage or loss caused by fraud (including misrepresentation), or death or personal injury caused by negligence.
    22. Terms with the effect of disclaiming liabilities in these Terms and Conditions shall be applied to the fullest extent permitted by applicable laws. 23. Each Eligible Customer agrees to indemnify and hold Samsung harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from any misconduct or negligence, as well as breach of these Terms and Conditions for which such Eligible Customer is liable. 24. If this Promotion is interfered with in any way or is not capable of being conducted due to any reason beyond Samsung's reasonable control, including but not limited to computer system defects, breakdown of web services, virus infection, hacking, technical failure and/or any force majeure events, Samsung reserves the right in its sole discretion to modify, suspend, terminate or cancel this Promotion, in whole or in part, as appropriate. Samsung shall not bear any liability therefrom. 25. In the event of any dispute arising from or in connection with this Promotion or relating to the interpretation of these Terms and Conditions, Samsung reserves the right of final decision. 26. By participating in this Promotion, each Eligible Customer agrees that any personal data provided in connection with this Promotion will be collected, used and retained by Samsung, its affiliates and its third party service providers (whether in Hong Kong or abroad) (collectively “Data Users”) for the purposes of (i) verifying eligibility and identity of Eligible Customer, and (ii) other purposes directly related to this Promotion. Such personal data will be kept in strict confidence and not be disclosed to other third party or used for any other purposes without Eligible Customer’s consent. Data Users will collect and use the personal data in compliance with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) and Samsung Privacy Policy. Please refer to Samsung website (https://www.samsung.com/hk_en/info/privacy/) for details of Samsung Privacy Policy, and request for access to or correction of any personal data. 27. No person other than the Eligible Customer and Samsung will have any right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce these Terms and Conditions or enjoy any benefits therein. 28. An English version of these Terms and Conditions is provided for reference only. If there is any inconsistency between the English and Chinese versions, the Chinese version shall prevail. 29. These Terms and Conditions and /or any claim or dispute arising from or in connection with this Promotion shall be governed by and construed in accordance with the Laws of Hong Kong, without regard to its conflict or choice of law provisions. The parties agree to the exclusive jurisdiction of the courts of the Hong Kong SAR. 30. If any terms in these Terms and Conditions is judged to be illegal, invalid or unenforceable, it shall be replaced by a term which achieves Samsung’s intention to the greatest extent possible, and the validity and enforceability of the rest of the Terms and Conditions shall not be affected.
