Terms and Conditions for Samsung.com/ca Referral Program
*Terms and conditions apply. Offer valid December 1, 2021 to January 25, 2022 (“Offer Period”). Offer available exclusively online at Samsung.com/ca. Usage may be restricted when used with any other offer, clearance, in-store or online promotion including but not limited to student discounts, Galaxy Week, Black Friday, Cyber Monday and Boxing Week offers.
Offer available to Canadian customers who pre-ordered Galaxy Flip3 or Galaxy Fold3 on samsung.com/ca during the pre-order period of August 11, 2021 – August 26, 2021 and completed their purchase (“Eligible Customers” or “Referrers”). Eligible Customers who have opted in to receive marketing communications from Samsung will receive an email invitation to participate in a Samsung referral program (“Referral Program”). A link to the Referral Program webpage will be included in the email. To access the Referral Program, follow the link and sign in with your Samsung Account. A Samsung Account is required. If you do not have a Samsung Account you can register for a new account at https://account.samsung.com/ Please note: To be eligible to participate in this promotion, your Samsung Account email must match the email that you used at the time of purchase of your new Galaxy Flip 3 or Fold3 device. Once you have signed in with your Samsung Account, your unique referral code (“Referral Code”) will be displayed at the following link: https://www.samsung.com/ca/mypage/myreferrals/. You can share your Referral Code with up to five (5) friends (“Friend(s)”).
The Referral Code may be redeemed by you Friend(s) on Samsung.com/ca as follows:
(i) Friends of Eligible Customers who pre-ordered and purchased Galaxy Z Fold3, will receive 5% off (before taxes) the purchase price of Galaxy Fold3; or
(ii) Friends of Eligible Customers who pre-ordered and purchased a Galaxy Z Flip3, will receive 5% off (before taxes) the purchase price of Galaxy Z Flip3 (each, an “Eligible Purchase”).
The Referral Codes expire on January 25, 2022. Each Referral Code may be used a maximum of 5 times.
Until January 25, 2022, each time (up to a maximum of 5 times) that your Friends subsequently complete an Eligible Purchase using your Referral Code, you will receive a referral credit redeemable on Samsung.com/ca (“Referral Credit”), as follows:
(i) For Eligible Customers, who pre-ordered and purchased Galaxy Z Fold3, you will receive $50.00 per Referral Code redemption up to a maximum of $250.00, redeemable on the purchase price (before taxes) of Galaxy smartphones, laptops, chromebooks, tablets, smartwatches, hearables and accessories; or
(ii) For Eligible Customers, who pre-ordered and purchased Galaxy Z Flip3, you will receive $30.00 per Referral Code redemption up to a maximum of $150.00, redeemable on the purchase price (before taxes) of Galaxy smartphones, laptops, chromebooks, tablets, smartwatches, hearables and accessories.
The Referral Credit will be provided to you in the form of a promotional code (“Promo Code”). The Promo Code must be redeemed no later than March 30, 2022, is single use only and is non-transferable. Any Referral Credit amount not used by March 30, 2022 will be deemed abandoned. Due to system restrictions, the value of the Promo Code may not exceed the total value of your cart (before taxes) at checkout.
The Referral Credit amount will be applied to the purchase price (before tax) of the eligible Galaxy products (as set out above) you select and add to your cart. Any amount in excess of the maximum Referral Credit amount for your selected eligible Galaxy poducts will be payable as part of your total order cost and will be shown as part of your final order total. Please note: If you select multiple products the credit will be split across the products. Referral Credit and Promo Code have no cash value and cannot be carried over, used in separate transactions, or refunded if you return any of the eligible Galaxy products. If you return any one of the eligible Galaxy products that formed part of your purchase, you will not receive a refund of the Referral Credit amount that was applied towards that particular eligible Galaxy product. Products may be purchased separately at regular prices. Open to Canadian Residents only. Samsung reserves the right to change or cancel this promotion without notice. How the Referral Program Works:
1. Participation. Eligibility to participate in the Referral Program is set out in the terms and conditions, above.
2. Making a Referral. Once you share your Referral Code with your Friends, up to 5 Friends may redeem the Referral Code to receive a discount on Samsung.com/ca[TJ1] . The Referral Code can only be redeemed once by each individual Friend and only 5 total usages of each Referral Code are allowed. If any one of the 5 Friends completes an Eligible Referral Purchase on Samsung.com/ca by no later than January 25, 2022 using the Referral Code, the Referrer will receive an email informing them of a redemption. [TJ2] A Referrer whose Friend(s) have redeemed their Referral Code will receive a Promo Code with their Referral Credit at the end of the campaign after February 1, 2022. The value of the Referral Credit will depend on the number of Friends who completed an Eligible Purchase (see details above). The Promo Code must be redeemed no later than March 30, 2022. If a Friend purchases without using the Referral Code, [TJ3] the purchase will not count as a qualified Referral and the Referrer will not receive the Promo Code. Any additional or subsequent purchases made by a Friend will not be considered qualified Referrals and thus not entitle the Referrer to additional Referral Credits. Referrers must respect the spirit of the Referral Program by only referring real individuals who are their friends and family and who meet the requirements of these Terms and Conditions. Referrers cannot use the Referral Codes for themselves. For example, a Referrer may not create multiple or fake accounts with Samsung using multiple or fake email addresses or identities.
3. Verified Qualified Referrals. Eligibility for both the Referral Codes and the Referral Credit/Promo Code are subject to verification. Samsung may delay redemption of a Referral Codes and/or the Referral Credit/Promo Code for the purposes of investigation. Samsung may also refuse to verify and process any transaction Samsung deems, in its sole discretion, to be fraudulent, suspicious, in violation of these Terms and Conditions, or believes will impose potential liability on Samsung, its subsidiaries, affiliates or any of their respective officers, directors, employees, representatives and agents. All of Samsung’s decisions are final and binding, including decisions as to whether a Referral Codes and the Promo Code is verified.
4. Fraudulent and Suspicious Behavior. Samsung reserves the right to disqualify any Referrer or Friend from participation in the Referral Program at any time at our sole discretion, including without limitation if the Referrer or Friend does not comply with these terms and conditions, or otherwise fails to comply with any applicable laws. Samsung may prohibit a Referrer or a Friend from participating in the Referral Program or receiving a Promo Code or Referral Code, in Samsung’s sole discretion, if Samsung determines that such Referrer or Friend is attempting to undermine the fairness, integrity or legitimate operation of the Referral Program in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other Referrers or Friends, or any representatives of Samsung. Use of any affiliate website, affiliate network properties, automated systems, script, or macro to participate is strictly prohibited and will result in disqualification from the Referral Program. Referrers and Friends may not enter with multiple or fake emails addresses or accounts, use fictitious identities or use any system, bot or other device or artifice to participate in the Program or receive a Reward. Samsung reserves the right to disqualify any Referrer or Friend and/or cancel any Promo Code or Referral Discount Code if Samsung finds a Referrer or Friend to be tampering with the redemption process or the operation of the Referral Program or violating these Terms and Conditions in any way.
5. Bulk Distribution ("Spam"). If a Referrer provides a Referral Link or Referral Code to a Friend by email, the email must be created and distributed in a personal manner that is appropriate and customary for communications with friends, colleagues and family members. Bulk referrals, distribution to strangers, or any other promotion of a Program in a manner that would constitute or appear to constitute unsolicited commercial email or "spam" in Samsung’s sole discretion is expressly prohibited and may be grounds for immediate termination of the Referrer's participation in the Program. Samsung has a no-tolerance spam policy. Referrer must comply with applicable law. Referrers who do not comply with the law, including antispam laws, are obligated to indemnify Samsung, as the case may be, against any liabilities, costs and expenses incurred as a results of such violation.
6. Privacy. Samsung is committed to protecting your privacy. We will not use or disclose your personal information for purposes other than those for which it was collected without your explicit consent as required by law. 7. Liability. Samsung takes no responsibility for lost, misdirected, or delayed claims. Incomplete or illegible request forms may delay fulfillment of your request. Samsung shall not be liable for any: (i) late, lost, delayed, stolen, misdirected, incomplete, unreadable, inaccurate, unreliable, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any printing, typographical, administrative or technological errors in any websites or materials associated with the Referral Program; (v) claims, demands, and damages in disputes among Referrers or between Referrers and Friends; (vi) any other injuries, losses or damages of any kind resulting from acceptance, possession or use of a reward, or from participation in the Referral Program; or (vii) any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Referral Program.
